I would like to request Environmental Permit (Industrial Installations) number EPR/XP3530UZ.

Response

We respond to requests for information under the Freedom of Information Act 2000 and Environmental Information Regulations 2004.

Please find the requested permit documents attached to this response. We have provided the following versions of Environmental Permit EPR/XP3530UZ: V001 (original permit), V002, and V004.

Please refer to the Open Government Licence which explains the permitted use of this information.

Personal data redactions

Some information within the permit documents has been redacted as it constitutes personal data under the Data Protection Act 2018 (DPA 2018). To disclose it would breach the First Data Protection Principle of the DPA 2018. This information is therefore exempt under Regulation 13(1) of the Environmental Information Regulations 2004, which explains that:

"To the extent that the information requested includes personal data of which the applicant is not the data subject, a public authority must not disclose the personal data if— (a) the first condition is satisfied..."

The 'first condition' referred to above is further explained in Regulation 13(2)(a):

"The first condition is that the disclosure of the information to a member of the public otherwise than under these Regulations— (a) would contravene any of the data protection principles..."

Disclosure of the redacted personal data to a third party would contravene the first data protection principle, as there is no lawful basis under UK GDPR to disclose the personal data of individuals who are not the applicant to a member of the public.

Rights of appeal

If you are not satisfied with our decision, you can contact us within two calendar months to ask for the decision to be reviewed. We will then conduct an internal review of our response to your request and give you our decision in writing within 40 working days.

If you are not satisfied with the outcome of the internal review, you can then make an appeal to the Information Commissioner Office, the statutory regulator for the Environmental Information Regulations 2004 and the Freedom of Information Act 2000.
