Please can I request the full permit for HB3801KC with the full list of EWC codes? I have checked the FOI site but can not find the information needed.
Response
We respond to requests for information that we hold under the Environmental Information Regulations 2004 (EIR). The Regulations require that we respond to requests by advising you whether information is held or not, and if so by providing you with that information.
Information held
We can confirm that we hold information falling within the scope of your request. Please find enclosed the following documents:
· Transfer Notice and Environment Agency initiated variation — EPR/HB3801KC/T001 (determined 06/12/2019)
· Original Waste Management Licence L104, including all conditions and amendments
· Appendix A — Schedule of Waste Categories (Categories A, B, C, and D)
Information warnings: (i) Personal data contained in these documents is exempt from the Open Government Licence. (ii) It is the responsibility of the licensee to ensure that the data they hold is accurate and up to date.

EWC codes
Please note that the permit documentation held by the Environment Agency for this site uses legacy waste categories (Categories A, B, C, and D, as set out in Appendix A of the original Waste Management Licence L104), rather than modern European Waste Catalogue (EWC) codes. This reflects the historical basis of the licence, which predates the current Environmental Permitting regime. We are not able to provide a schedule of EWC codes as a separate document, as no such schedule is held as part of the current permit record for EPR/HB3801KC.
Redaction of personal data
Certain information within the enclosed documents — specifically the signatures of named individuals — has been redacted prior to disclosure. We are unable to disclose this information as it constitutes personal data under the Data Protection Act 2018 (DPA 2018), and to disclose it would breach the First Data Protection Principle of the DPA 2018. This information is therefore exempt under Regulation 13(1) of the Environmental Information Regulations 2004, which provides that:
"To the extent that the information requested includes personal data of which the applicant is not the data subject, a public authority must not disclose the personal data if — (a) the first condition is satisfied..."
The 'first condition' referred to above is further explained in Regulation 13(2)(a):
"The first condition is that the disclosure of the information to a member of the public otherwise than under these Regulations — (a) would contravene any of the data protection principles..."
Disclosure of the signatures of named individuals to a third party would contravene the first data protection principle, as there is no lawful basis for such disclosure and the individuals concerned would have a reasonable expectation that their personal data would not be released in this manner.
Rights of appeal
If you are not satisfied with our decision, you can contact us within two calendar months to ask for the decision to be reviewed. We will then conduct an internal review of our response to your request and give you our decision in writing within 40 working days.
If you are not satisfied with the outcome of the internal review, you can then make an appeal to the Information Commissioner's Office, the statutory regulator for the Environmental Information Regulations 2004 and the Freedom of Information Act 2000.
