We respond to requests for information under the Freedom of Information Act 2000 and Environmental Information Regulations 2004.

Redactions — Personal Data
Please note that certain information has been redacted from the enclosed permit. We are unable to disclose the names of individuals appearing within the document, as this is personal data under the Data Protection Act 2018 (DPA 2018) and to disclose it would breach the First Data Protection Principle of the DPA 2018. This information is therefore exempt due to Regulation 13(1) of the Environmental Information Regulations 2004, which explains that:
"To the extent that the information requested includes personal data of which the applicant is not the data subject, a public authority must not disclose the personal data if — (a) the first condition is satisfied..."
The 'first condition' referred to above is further explained in Regulation 13(2)(a):
"The first condition is that the disclosure of the information to a member of the public otherwise than under these Regulations — (a) would contravene any of the data protection principles..."
The names redacted from this document are the personal data of individuals who are not the data subject of this request. Disclosing their names would contravene the first data protection principle, which requires that personal data be processed lawfully, fairly, and transparently. There is no lawful basis under the DPA 2018 that would permit disclosure of this personal data in response to an information request.
Rights of Appeal
If you are not satisfied with our decision, you can contact us within two calendar months to ask for the decision to be reviewed. We will then conduct an internal review of our response to your request and give you our decision in writing within 40 working days.
If you are not satisfied with the outcome of the internal review, you can then make an appeal to the Information Commissioner's Office, the statutory regulator for the Environmental Information Regulations 2004 and the Freedom of Information Act 2000.
